In view of the externality of copyright system for information resources sharing of public welfare digital libraries, the article studies how to improve or affect the external factors and provides methods for improving the positive externality of copyright system in information resources sharing of digital libraries.
The article introduces the Google Book Search simply at first, then reviews the matter which arisen in the Google library program, and analyses the motive of Google Book Search in economic and cultural view. The authors also analyze the issue about copyright which arisen in Google Book Search, including the fair use, opt out and settlement agreement. This article considers that Google can`t be protected by fair use defense.
The article first analyze the dilemmas of now available methods of copyright in digital libraries. Based on it, the authors discuss necessity of statutory licensing system of network dissemination. Then, the authors draw on the experience of the idea of copyright compensation, build a blueprint of digital libraries. statutory licensing system of network dissemination, and design the obligation undertaken by digital libraries and corresponding management system, so that it can make statutory licensing with more practicability.
